Hamdan vs. Rumsfeld 548 US 557 (2006) - Case Study Example Bush, President of the United States. After a year of detention, President Bush deemed him eligible to be tried before a military commission that was authorized under Military Commission Order No. 1. The military commission would have allowed the inclusion of evidence with no probative value or acquired through illegal means, made it possible that there be evidence used against the accused that the accused would not be able to see, and the appeals would only be within the Executive branch. Opposing this, Hamdan filed a writ of habeas corpus, in chief arguing that a military commission conducting trial in violation of the Uniform Code of Military Justice (UCMJ) and the Geneva Conventions should be declared illegal and with no power to proceed. Procedural History: Hamdan filed his petition before the United States District Court for the District of Colombia, which found in his favor. Upon Appeal, the United States Court of Appeals for the District of Columbia Circuit unanimously revers ed the decision of the District Court. Subsequently, on 7 November 2005 the Supreme Court issued a writ of certiorari to hear the case, and it was argued before the said court on 28 March 2006. On 29 June 2006, the Supreme Court issued its decision, reversing the Court of Appeals and finding in favor of Hamdan. Issues: 1. The first issue is whether or not the provisions in the military commission that would allow the accused to be convicted using evidence that he had not seen or heard, or evidence that may not be in compliance with admissibility or relevancy rules in other court martial proceedings violate the uniformity rule and the principle that â€Å"no procedural rule must be contrary or inconsistent with the UCMJ†? 2. The second issue is whether or not Hamdan can invoke the guarantees of the Geneva Conventions given the contextual background of the capture of Hamdan, and giving due regard to the fact that such capture was done pursuant to the war with Al Qaeda, which is not a High Contracting Party to the Conventions? Holding: The Supreme Court answered in the affirmative to both questions. It held firstly that the deviations in the military commission rendered it defective, and secondly, that the Geneva Conventions could be validly invoked by Hamdan. Rationale: The Supreme Court relied on the case of Ex Parte Quirin, 317 U.S. 1 (1942) as justification for granting certiorari to Hamdan, stating that trial by military commissions surfaces important questions about the balance of powers of the three branches of government. Likewise, the case of In Re Yamashita 327 U.S. 1, 11 (1946) recognizes that the exigencies of war may demand extraordinary measures. In the case of Hamdi v. Rumsfeld, 542 U.S. 507 (2004) it reaffirmed the war powers of the President, including the authority to convene military commissions. With respect to the first question, the Supreme Court noted that in the military commission created by Military Commission Order No. 1, Section 6 permits exclusion of the accused from proceedings and denial of his and his civilian counsel’s access to evidence that may be used to convict him. The global pattern of international flows may be experience by a combination of push and pull factors that encourage to study eversea. Pull factors operate within a host country to make that country relatively attract to international students. Some of these factors are inherent in the source country, some in the host contry and other in the students themselves. In the other hand, Bakalis S. and Joiner T. A. In year 2009 worldwide  Open Doors  report shows that the total number of international students at colleges and universities in the United States increased by 8% to an all time high of 671,616 for the 2008/09 academic year. Moreover, Malaysia is ranked as 21st among other countries sending students to the United States with 5,942 having enrolled for the 2008/09 academic. This show United States remained a top destination for Malaysian students who wanted to study abroad due to the quality and prestige associated with an American degree. The Dopamine Hypothesis of Schizophrenia Schizophrenia is a disease that has plagued societies around the world for centuries, although it was not given its formal name until 1911. It is characterized by the presence of positive and negative symptoms. Positive symptoms are so named because of the presence of altered behaviors, such as delusions, hallucinations (usually auditory), extreme emotions, excited motor activity, and incoherent thoughts and speech. (1,2) In contrast, negative symptoms are described as a lack of behaviors, such as emotion, speech, social interaction, and action. (1,2) These symptoms are by no means concrete. Not all schizophrenic patients will exhibit all or even a majority of these symptoms, and there is some disagreement in the psychiatric community as to the exact diagnostic criteria. In addition, there is a great deal of debate as to the causes of the disease. While some proposed causes have been proven false, such as bad parenting and poor will power (2), there are many theories that remain. One of the most famous and most debatable is the dopamine hypothesis. The proposed hypothesis states that the brain of schizophrenic patients produces more dopamine than normal brains. It is this increased dopamine that is believed to be responsible for the symptoms of the disease. However, the is much debate in the scientific community as to the exact mechanism by which altered dopamine levels, especially in the prefrontal cortex, striatum, and limbic system, produce schizophrenia. Robin Hood Essays - English-language Films, British Films, Merry Men Robin Hood Robin Hood, by Paul Creswick, is a story of great triumph. Many people know the myth of Robin Hood, but they do not know the life of Robin Hood. It is a good novel to read if the reader likes stories of a true legend. Also, it is a novel that deals with friendship, motivation, action, bravery, and love. The novel is primarily based on friendship. The friends that Robin makes and the camaraderie they share makes this a terrific book. Living in the forest, away from the law, they are all outlaws and they are all there for each other when trouble presents its self. One example is when one of the outlaws, Little John,is about to be hung, the rest of the crew risked life and limb to save his life. A few of the members even died trying to help Little John escape, but they all knew that was the meaning of friendship. When one of the outlaws was sick or wounded, someone always stayed with them and made sure he got better. With their friendship came trust. All of the outlaws knew that they could trust each other, no matter what the situation presented. If one of the outlaws went into the city to buy goods, the others knew that he would not run off with the money or tell the Sheriff where they were hiding. A good example of that is when Will Stutely had a falling out with the gang. He went and worked in the sheriff?s kitchen as a cook, and even though he had left the gang and was employed by the law, he still kept the hiding place secret and told noone the where abouts of Robin Hood. Another reason the novel is good to read is the motivation the gang has. Their primary motivator is freedom. Everything they do is to try to gain freedom from the crooked king. They live in caves throughout the woods and sleep on the hard ground because they are just glad to be free there. In the forest, they make their own laws and obide by them strictly. If someone does not obey the laws set by the gang, then they are kicked out of the forest and must live in the non-democratic city and give up their freedom. Once the gang leaves the forest though, they have no respect for any laws but their own. Their secondary motivator is money. They do not obtain money honestly. They rob the rich people that travel through the forest and give it to the people that are traveling through the forest that need it, as long as they promise to pay it back. An example from the book is where a Knight that owes a rich Bishop two hundred dollars is traveling through and meets Robin and the gang. After Robin tried to rob the Knight, the Knight tells him that he is poor and owes the Bishop money he had borrowed to feed his family. Robin gave the Knight the two hundred dollars that Robin had stole from the Bishop in the first place. The Knight took the money, but had to promise to pay it back in one year. So unlike the myth, Robin Hood did not give the poor people money, he loaned money. And if the person couldn?t pay it back, they couldn?t borrow it. But, that is how many of the people joined Robin?s gang. They wanted to be free of debt and obtain freedom, so they took the oath of friendship and were in the gang. If an action/adventure book is what a reader is looking for, I would have to say that few books compare with Robin Hood. From the opening page until the end, there is always something going on. On every walk Robin takes, he gets into a fight with somebody. A few words of disrespect towards Robin are spoken, and the sword is out. Usually, after the fight, Robin and his opponent become friends, and a new member of the gang is found. That is how Robin met Little John, and a few other members of the gang. dental phobia essays My intervention is based on "John", a 15-year-old boy who has a phobia of dentists. Other than this, he shows no other mental problems, he has had some unrelated disciplinary problems at school, and also has no fear of doctors or needles. His dental phobia has prohibited him from seeing a dentist in 6 years. He has avoided dental appointments by not turning up, whilst also undertaking strict teeth cleaning behaviours, such as religious brushing, to avoid the chance that he may need dental intervention. He has even expressed a dislike for very hard food as he may damage a tooth, requiring dental intervention. John's parents could not specify the phobia's starting point, only that it had been around ever since they could remember. He has not tried any methods to solve his phobia to date, however his parents have attended dental appointments and offer him support to get through them. These have only produced refusals to get in the car to go to appointments, and to even go inside the surgery. I conducted an interview with John on our first meeting, where I simply talked to him and asked him questions in order to get background information on his problem and gauge the severity of it. There was no specific questions asked, or recordings made. The first scale I used to gauge the progression of John, was the Dental Fear Survey (DFS) presented in Appendix 1. This was administered at the start of therapy, and then again at the halfway point of therapy, as well as at the end. The DFS is a 20 item self-report measure that allows assessment of dental anxiety on three subscales, fear stimuli (items 14-18), physiological arousal (items 3-7), and dental avoidance tendencies (items 1,2" 9,10,11,12,13 & 20) (Malouff & Schutte, 1995). Each item is scored with a 5-point scale, with 1 being low anxiety and 5 highly anxious. The higher the score in each section, the more dental anxiety experienced. Some of the primary contributing factors that lead to this behavior in children at school are poor socio- economic background, conflict in the family brought about by divorce and alcohol and drug abuse and in cases of minority groups that are segregated and discriminated in society. It is mostly children who come from such backgrounds that are troublesome and misbehave in school. Sometimes when children are very tired, hungry or ill misbehave for a temporary period. However, long term misbehavior does not fall under this category because of the complexity involved. Children could also misbehave when they feel bad they are not in cont rol of the situation. In such cases they try to retaliate and take revenge for their satisfaction. In such situations the child lacks maturity and is unable to handle the situation and so exhibits poor behavior. Self esteem and confidence play major roles in the life of a child and when it is lacking there is bound to be disciplinary problems. Craving for attention is another spoke in the wheel of good behavior and when children do not get the attention they deserve, they resort to different ways in order to either gain attention or divert ones attention to keeping a check on their behavior. Misbehavior in the true sense of the word occurs when a child â€Å"chooses† to misbehave. Poor discipline or misbehavior results in poor learning outcomes. Therefore, if the teacher needs the child to do better academically, then the forst place to start the intervention would be to check the student’s behavior from the onset. Not completing one’s homework, absenting onesel f from school or been inattentive in the classroom, leads to less acquiring of knowledge and further behavioral problems. In such a scenario, the teacher plays a pivotal role in the life of the child and through counseling and other strategies should try their best to get the child back on the right track. Prevention of Misbehavior The first step towards teaching a child good behavior is by explaining and making them understand that bad behavior is inappropriate and unacceptable. Timely interventions when teaching a child how to behave in the right manner is indispensable. In case, the child lacks confidence and self esteem, the teacher could play a major role in the child’s life by providing him good opportunities to give expression to his work, thereby making the child more confident about himself. For children who crave attention by misbehaving, the teacher could spare some time and listen to the child’s problems and provide a portent platform for the child to get t he attention he needs. Children who come from homes where the parents are divorced should be given proper counseling in order to learn coping strategies that would help them along in their own lives. Single parent children who misbehave should be advised by the teacher on how to cope with the problems at home and make adjustments by accepting their single parent status.
